South Africa Online ® Terms and Conditions

The following terms and conditions form the basis of your contract with South Africa Online ®

Interpretations

  • Headings are for reference only and don’t affect interpretation.
  • Words implying one gender include all genders; singular includes plural, and vice-versa.
  • "South Africa Online" refers to South Africa Online ®, and "the client" refers to the person or agent making the booking.

Applicability

  • All services and advice provided by South Africa Online are subject to these terms.

South Africa Online as Agent

  • South Africa Online acts only as an agent for clients in securing services from third-party providers and isn’t responsible for the actions and omissions of these providers.

Quotations, Payment, and Currency Fluctuations

  • All quotations given by South Africa Online in connection with the services to a client shall be in writing. Acceptance of any quotation by a client shall be in writing.
  • Quotations are in South African Rand (Inclusive of South African value added tax where applicable) and may change due to currency fluctuations or third-party price increases.
  • Payments must be made within 3 days of booking confirmation, and additional costs due to exchange rates or third-party price changes are the client's responsibility.

Items Not Included

  • Costs like insurance for cancellation and curtailment, medical expenses, emergency evacuations, gratuities and beverages, optional meals and any optional excursion not reflected on the booking reservation are the client’s responsibility.

Booking Procedure

  • A 25% deposit is required for provisional bookings. In the event of the deposit not being paid aforesaid, the provisional booking shall lapse. 
  • Full payment is due 60 days before departure. On receipt of the balance of money due, the provisional booking will be confirmed.
  • Any changes to bookings may incur a 3% amendment fee.
  • All special requests, requirements relating to medical needs, disabilities and special dietry requirements must be advised by the client to South Africa Online in advance. The cost of the special requests shall be borne by the client and payable on demand.

Cancellations and Refunds

  • Cancellations must be made in writing. Refunds depend on the notice period given, with less refund available as the departure date approaches. 
  • The following cancellation fees shall be applicable and shall be calculated by reference to the total booking cost (“TBC”) of the services booked for by the client.
  • 56 or more days notice is given 75 percent of the TBC shall be refunded
  • 55 - 49 days notice is given 50 percent of the TBC shall be refunded
  • 48 - 42 days notice is given 25 percent of the TBC shall be refunded
  • 41 - 35 days or less notice given no refund of the TBC shall be made
  • No refunds are given for late arrivals, no-shows, or early departures.
  • Clients are therefore strongly recommended to obtain their own comprehensive travel insurance to cover such contingencies.
  • Any cancellations made, in terms of these standard trading conditions shall be subject to administrative charges.

Right of Retention

  • South Africa Online will not release travel documents until full payment is received.

Alterations to Itineraries

  • South Africa Online may alter or cancel services at its sole discretion due to unforeseen circumstances. 
  • South Africa Online may further in its sole discretion cancel or terminate a client’s booking for the services or any remaining part thereof in the event of any illness or the illegal or incompatible behaviour of the client, who shall, in those circumstances, not be entitled to any refund. 
  • Additional costs due to changes are the client’s responsibility.

Insurance

  • Clients must arrange their own travel and medical insurance. South Africa Online is not liable for any costs arising from lack of insurance.

Vaccinations and Health

  • Clients are responsible for obtaining necessary vaccinations and health advice before travel. South Africa Online is not responsible if a client is denied entry due to improper documentation or vaccinations

Passports, Visas, and Medical Requirements

  • Clients must ensure their passports, visas, and medical documents are in order prior to travelling.
  • South Africa Online is not liable for any issues arising from incorrect or incomplete documentation.

Disclaimer of Liability

  • South Africa Online is not liable for any damages or losses unless caused by their wilful misconduct and reported within 7 days of the incident.

Consent to Risks

  • Clients understand the risks of wildlife adventure travel and assume these risks at their own responsibility.

Air Travel

  • Airfares are subject to change and South Africa Online is not responsible for missed connections or flight changes.

Child Policy

  • Children 12 and older are charged as adults. 
  • Some accommodations have age restrictions or activity limitations for children. This is at the discretion of the supplier and needs to be confirmed with South Africa Online at the time of booking.
  • South Africa Online cannot be held liable for any changes to the suppliers’ child policy.

Client Defaults

  • Overdue payments will incur interest. South Africa Online’s certificate of outstanding amounts will be considered proof in legal proceedings.

Photographic Material

  • South Africa Online shall be entitled to use photos and videos of clients taken during trips for promotional purposes without compensation.

Applicable Law

  • These terms and conditions are governed by South African law.

Jurisdiction

  • Legal proceedings will be conducted in the Cape of Good Hope High Court, unless South Africa Online chooses a different jurisdiction.

Variation of Terms

  • Changes to these terms and conditions must be in writing and signed by South Africa Online to be valid.

Non-Waiver

  • Any relaxation of terms by South Africa Online does not affect its right to enforce them later.
